1. Purpose and Scope
This Returns, Refunds & Warranty Policy (“Policy”) applies to all goods (“Goods”) and services (“Services”) supplied by H&K Global Trading Pty Ltd (“H&K”, “we”, “us”, “our”) to business customers (“Buyers”, “you”, “your”).
It is designed to ensure fair, transparent, and efficient resolution of quality or delivery issues in accordance with:
• The Australian Consumer Law (ACL);
• The United Nations Convention on Contracts for the International Sale of Goods (CISG); and
• Applicable international trade and Incoterm standards.

2. Eligibility for Returns and Claims
2.1 Returns are accepted only in cases where:
• Goods are faulty, defective, or materially non-conforming with approved specifications, samples, or technical packs;
• Goods are damaged in transit under H&K’s responsibility per the agreed Incoterm; or
• H&K has otherwise agreed in writing to accept a return.
2.2 Returns for change of mind, overstock, or resale issues are not accepted for B2B transactions.
2.3 Buyers must submit all claims within 20 business days of receiving the Goods. Claims made after this period may not be considered.

3. Inspection and Reporting Requirements
3.1 Buyers are responsible for inspecting all Goods promptly upon receipt.
3.2 To lodge a return or claim, Buyers must:
• Notify H&K in writing (info@handkglobaltrading.com);
• Provide the purchase order number, invoice reference, and photographs/videos showing the issue; and
• Retain the Goods in their original packaging until H&K authorises a return or other resolution.
3.3 If inspection is delayed due to customs clearance, H&K must be notified immediately to extend claim validity.

4. Return Authorisation Procedure
4.1 Returns must be pre-approved by H&K in writing. Goods returned without authorisation will not be accepted or credited.
4.2 Once approved, H&K will provide:
• A Return Authorisation (RA) reference number;
• The designated return address; and
• Instructions for packaging and shipping.
4.3 Returned Goods must be:
• In their original condition (unworn, unused, unaltered); and
• Accompanied by all tags, labels, and documentation.

5. Freight & Costs
5.1 The Buyer is responsible for return shipping costs unless:
• The Goods are faulty or defective; or
• The return was caused by H&K’s error (e.g. incorrect item, quality failure).
5.2 In cases where H&K accepts liability, we will arrange return freight or reimburse verified shipping costs.
5.3 Freight and handling costs are non-refundable unless otherwise required by law.

6. Remedies
Upon receiving and verifying returned Goods, H&K may, at its discretion:
• Repair defective Goods;
• Replace the Goods with new or conforming items;
• Issue a credit note towards future orders; or
• Provide a refund via the original payment method.
Refunds are processed within 14 business days of confirmation.

7. Quality Assurance & Third-Party Inspection
7.1 H&K conducts pre-shipment quality control (AQL) inspections in collaboration with certified third-party auditors.
7.2 Buyers are encouraged to arrange independent pre-shipment inspections if required. H&K will cooperate fully to facilitate these inspections.
7.3 Post-delivery claims based on subjective preferences (e.g. colour variation, fabric hand feel, or style interpretation) will not qualify as manufacturing defects.

8. Warranty
8.1 All Goods supplied by H&K carry a six-month manufacturing warranty against defects in materials or workmanship from the date of delivery.
8.2 This warranty excludes:
• Normal wear and tear or misuse;
• Damage caused by improper storage, handling, or washing;
• Alterations made by third parties;
• Delays or defects arising from Buyer-supplied materials.
8.3 Warranty claims will be honoured through repair, replacement, or credit at H&K’s discretion.

9. Limitation of Liability
9.1 To the maximum extent permitted by law, H&K’s liability is limited to:
• The replacement or repair of defective Goods; or
• The value of the Goods supplied under the relevant Order.
9.2 H&K is not liable for indirect or consequential losses, including but not limited to:
• Lost profits, opportunities, or reputation;
• Business interruption or production downtime; or
• Delays caused by shipping, customs, or third-party carriers.
9.3 Nothing in this Policy limits your rights under the Australian Consumer Law (ACL) or any other mandatory law that cannot be excluded.

10. International Orders & Jurisdiction
10.1 For cross-border orders, this Policy operates in conjunction with the relevant Incoterm (2020) and CISG obligations.
10.2 Any disputes will be governed by the laws of New South Wales, Australia, and resolved under the jurisdiction of its courts.
10.3 Where arbitration is mutually agreed, proceedings will be conducted under the ACICA (Australian Centre for International Commercial Arbitration) Rules.
